Terms of Service

Welcome to KOKO Music ("KOKO Music", "we", "us", "our"), an AI music-generation service operated from Australia at music.hjstudio.au. By creating an account, buying credits, or using the service (the "Service"), you agree to these Terms of Service ("Terms"). If you do not agree, please do not use the Service.
1. The Service
KOKO Music lets you generate music, lyrics, cover versions, music videos and related audio using third-party AI models (including the Suno family of models accessed through our upstream providers). Output quality, availability and model versions depend on those providers and may change without notice.
2. Accounts & access
- Registration is currently by invite code. You must provide accurate details and keep your password secure.
- You are responsible for all activity under your account. Tell us promptly at support@hjstudio.au if you suspect unauthorised use.
- You must be at least 16 years old, or the age of digital consent in your country, to use the Service.
3. Credits, plans & payment
- The Service runs on credits. 1 song = 10 credits; a music video = 2 credits. Prices are shown in Australian Dollars (AUD) and include GST where applicable.
- Subscription plans grant a monthly credit allowance. Top-up packs add credits that do not expire while your account is active.
- Payments are processed by Stripe. We do not store your full card details.
- Subscriptions renew automatically until cancelled. You can cancel anytime from My Credits → Manage plan; access continues until the end of the paid period.
- Credits have no cash value, are non-transferable, and are not redeemable for money except where required by law.
4. Refunds & consumer rights
Nothing in these Terms limits your rights under the Australian Consumer Law. Our services come with guarantees that cannot be excluded. If a generation fails due to a fault on our side, the reserved credits are automatically refunded to your balance. Because generated content is created and delivered to you on demand, unused subscription time and consumed credits are otherwise generally non-refundable. If something goes wrong, contact us and we will make it right.
5. Acceptable use
You agree not to use the Service to create, upload or distribute content that:
- infringes anyone's copyright, trademark, or other rights — including deliberately imitating a real artist's voice or a specific copyrighted recording;
- is unlawful, defamatory, hateful, harassing, or promotes violence;
- impersonates a real person without consent, or is designed to deceive or defraud;
- is sexual content involving minors, or otherwise violates the law; or
- attempts to reverse-engineer, overload, scrape, or circumvent limits of the Service.
We may suspend or terminate accounts that breach these rules, and may remove content or report unlawful activity to authorities.
6. Your content & ownership
- You retain ownership of the prompts and lyrics you supply ("Inputs").
- Subject to your compliance with these Terms and the terms of the upstream AI providers, you own the music and media you generate ("Outputs") and may use them, including commercially where your plan permits.
- You grant us a limited licence to host, process and store your Inputs and Outputs solely to operate and improve the Service.
- AI outputs may be similar to content generated for other users. We make no warranty that Outputs are unique or free of third-party rights, and you are responsible for how you use them.
7. Third-party services
The Service depends on third parties (including AI model providers, Stripe for payments, and cloud hosting). We are not responsible for outages, changes, or acts of those providers, and their terms may also apply to you.
8. Disclaimers & liability
The Service is provided "as is". To the maximum extent permitted by law, and other than guarantees that cannot be excluded under the Australian Consumer Law, we exclude all warranties and our total liability to you for any claim is limited to the greater of (a) the amount you paid us in the 3 months before the claim, or (b) the resupply of the affected service. We are not liable for indirect or consequential loss.
9. Termination
You may stop using the Service at any time. We may suspend or close accounts that breach these Terms or where required by law. On termination, unused credits are forfeited except where the law requires otherwise.
10. Changes
We may update these Terms as the Service evolves. Material changes will be notified on this page with a new "Last updated" date. Continued use after changes means you accept them.
11. Governing law
These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of its courts.

2. 账号与访问
- 目前采用邀请码注册。你须提供真实信息并妥善保管密码。
- 你对账号下的所有活动负责。若怀疑账号被盗用，请立即邮件联系 support@hjstudio.au。
- 你须年满 16 周岁，或达到所在国家/地区的数字同意年龄，方可使用本服务。
3. 积分、套餐与付费
- 本服务以积分计费。一首歌 = 10 积分；音乐视频 = 2 积分。价格以澳元（AUD）显示，适用时含 GST。
- 订阅套餐每月发放积分额度；加油包积分在账号有效期内不过期。
- 付款由 Stripe 处理，我们不存储你完整的银行卡信息。
- 订阅自动续费直至取消。你可随时在 我的积分 → 管理订阅 取消，已付费周期结束前仍可使用。
- 积分无现金价值、不可转让，除法律要求外不可兑换为现金。
4. 退款与消费者权利
本条款不限制你在澳大利亚消费者法（Australian Consumer Law）下的权利，我们的服务附带不可排除的保障。若因我方故障导致生成失败，已预扣的积分会自动退回你的余额。由于生成内容是按需即时创建并交付给你的，除此之外，未使用的订阅时长与已消耗的积分通常不予退款。若出现问题，请联系我们，我们会妥善处理。
5. 可接受使用
你同意不使用本服务创建、上传或传播以下内容：
- 侵犯他人著作权、商标权或其他权利——包括刻意模仿真实艺人的声音或特定受版权保护的录音；
- 违法、诽谤、仇恨、骚扰或宣扬暴力的内容；
- 未经同意冒充真实人物，或旨在欺骗、诈骗的内容；
- 涉及未成年人的色情内容，或其他违法内容；或
- 试图逆向工程、超载、抓取或规避本服务的限制。
对于违反上述规则的账号，我们可暂停或终止，可删除内容，并可向有关部门举报违法行为。
6. 你的内容与归属
- 你提供的提示词与歌词（"输入"）归你所有。
- 在你遵守本条款及上游 AI 供应商条款的前提下，你生成的音乐与媒体（"输出"）归你所有，可在套餐允许范围内使用，包括商用。
- 你授予我们有限许可，仅为运营和改进服务而托管、处理、存储你的输入与输出。
- AI 输出可能与为其他用户生成的内容相似。我们不保证输出唯一或不涉及第三方权利，你需为使用方式自行负责。
7. 第三方服务
本服务依赖第三方（含 AI 模型供应商、支付服务 Stripe、云托管等）。我们不对这些供应商的中断、变更或行为负责，其条款也可能适用于你。
8. 免责与责任限制
本服务按"现状"提供。在法律允许的最大范围内，除澳大利亚消费者法下不可排除的保障外，我们排除一切保证；对任何索赔，我们对你的总责任以下列较高者为限：(a) 索赔前 3 个月你向我们支付的金额，或 (b) 重新提供受影响的服务。对于间接或后果性损失我们概不负责。
9. 终止
你可随时停止使用本服务。对违反本条款或法律要求的账号，我们可暂停或关闭。终止时，除法律另有要求外，未使用的积分作废。
10. 条款变更
随服务演进我们可能更新本条款。重大变更将在本页更新"最近更新"日期予以告知。变更后继续使用即视为接受。
11. 适用法律
本条款受澳大利亚新南威尔士州法律管辖，你同意接受其法院的非专属管辖。
